Terms of service

These terms govern your use of gardenglowshop.com and any order you place with us. Please read them. By placing an order you accept them.

Who we are. Garden Glow Supply is a trading name of HOMART LIMITED, registered in England and Wales, company number 15257354, registered office 30 Uphall Road, Ilford, England, IG1 2JF. Contact: support@homartuk.com, 07868 375682.

1. The contract

Your order is an offer. A contract exists when we email to confirm despatch, or — for made-to-order schemes and rigs — when we acknowledge your order in writing. The confirmation following checkout acknowledges receipt, not acceptance. We may decline an order; if we do we refund you in full and tell you why.

2. Prices and errors

Prices are in pounds sterling and include VAT where applicable. Delivery is charged separately and shown at checkout. If an item is listed at an obviously wrong price we are not obliged to supply it at that price; we will contact you and you may confirm at the correct price or cancel for a full refund.

3. Electrical installation — the important clause

Our 12V products are extra-low voltage and are designed to be installed by a competent person without an electrician. The 230V supply feeding the transformer is not.

In England and Wales, installing a new circuit is notifiable under Part P of the Building Regulations, and providing an outdoor socket or a garden supply is usually a new circuit. Scotland and Northern Ireland operate their own systems. Any 230V work must be carried out by a person competent to do so, in accordance with BS 7671, and it is your responsibility to arrange it and to obtain any certification required. We do not carry out electrical work and we accept no liability for 230V installation.

4. Installation, burial and drainage

Unless we have quoted for installation in writing, installation is yours. In particular:

  • Buried cable must be laid at an appropriate depth with warning tape above it. We recommend 300mm in soft ground and 450mm under anything that may be dug or driven over.
  • Buried joints must use IP68 gel-filled or resin-filled connectors. Joints made with unrated connectors are not covered by our guarantee.
  • In-ground fittings must be installed with the supplied drainage sleeve and free-draining shingle. Fittings that fail having been installed in standing water are not covered.
  • You are responsible for checking for buried services before digging.

5. Sizing, guidance and calculations

Our guidance pages — including Sizing a Transformer and Cable, 12V or Solar? and Dark Sky and Wildlife — are general information given in good faith and referenced to published sources where stated. They are not a lighting design, an electrical design or an ecological assessment for your site.

Where we size a transformer, cable or run from information you supply, that advice is given free of charge and in good faith on the basis of the measurements provided. It remains your responsibility, or your electrician's, to satisfy yourself that the installation is suitable and safe.

6. Solar performance

Solar products are powered by ambient daylight and their output varies substantially with season, siting, shading, weather and battery age. Output in the UK between November and January is a small fraction of summer output. We state this on every solar product page and on 12V or Solar?. Reduced winter performance, and the gradual loss of rechargeable battery capacity, are characteristics of the product and not defects.

7. IP ratings

Stated IP ratings describe tested resistance to dust and water ingress. IP67 denotes temporary immersion and IP68 continuous immersion to a stated depth. A rating is not a warranty that a fitting may be permanently submerged, buried in standing water, or installed outside the conditions in its instructions.

8. Cancellation and returns

Your rights are set out in full on Returns & Refunds, which forms part of these terms. Cable cut to a length you specify and bespoke schemes are exempt from the 14-day cancellation right.

9. Delivery and risk

Delivery terms are on Delivery, which forms part of these terms. Risk passes to you on delivery; title passes when we have received payment in full. Pallet delivery is kerbside. Delivery dates are estimates given in good faith, and lead times published on product pages are current at the time of ordering.

10. Light nuisance and neighbours

You are responsible for how your lighting is aimed and how long it runs. Artificial light spilling onto neighbouring property can constitute a statutory nuisance under the Environmental Protection Act 1990. Our dark sky page explains how to avoid it; we accept no liability for nuisance, planning breach or complaint arising from how our products are installed or used.

11. Protected species

All UK bat species and their roosts are legally protected, as are certain other species and habitats. Where lighting may affect a roost, a watercourse or a designated site, obtaining appropriate ecological advice is your responsibility.

12. Guarantee

We guarantee our own-brand manufacture against defects in materials and workmanship for two years from delivery, in addition to and without affecting your statutory rights. Manufacturers' guarantees on branded fittings are stated on the product page. The guarantee does not cover fair wear and tear, accidental damage, consumables (lamps, batteries), incorrect installation, unrated buried joints, fittings installed without drainage, damage by flood or frost, or modification.

13. Trade and business customers

Where you buy in the course of a business, the consumer cancellation right does not apply and our liability is as set out in clause 15. Nothing in these terms excludes liability that cannot lawfully be excluded. Trade account terms granted in writing prevail over any inconsistent term here.

14. Intellectual property

All content on this site — text, photography, guides and product descriptions — belongs to HOMART LIMITED or is used with permission. You may not reproduce it commercially without our written consent. Drawings, plans and measurements you send us remain yours, and you confirm you have the right to give them to us.

15. Our liability

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for breach of the terms implied by the Consumer Rights Act 2015, or for anything else that cannot lawfully be limited.

Subject to that: we are not liable for loss of profit, loss of business, loss of an event, damage to planting, hard landscaping or buried services arising from installation, or any indirect or consequential loss. Our total liability in connection with an order is limited to the price paid for that order.

16. Data protection

We process personal data in accordance with our Privacy Policy, which forms part of these terms.

17. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts. If any provision is unenforceable, the rest stands.

18. Changes

We may amend these terms. The version in force is the one published here at the time you place your order.
